C&S reserves the right to discontinue the production of the products offered on this site or to change their specifications without notice and without incurring any obligation. C&S operates this site from its offices located in Montreal, in the province of Quebec (Canada). Any claim relating to the site and the elements it contains, or arising from its use is therefore governed by the laws applicable in the territory of the province of Quebec.


Acceptance of an order
Receipt of the order confirmation email does not automatically mean that C&S accepted the order and is not a confirmation that C&S undertakes to sell anything. C&S reserves the right, without any prior notice, to refuse to do business with any client order and/or limit the quantity for any item of an order. It may be necessary to C&S and at any time, to verify personal or credit card-related information before accepting any order.

Terms of payment & Security
We guarantee that all your transactions on the Website are entirely secure while using the intern system by PayPal or Stripe. The transmitted information is encrypted using the SSL protocol. IN NO CASE CAN Charme & Sortilege Inc, nor any of its administrators, be held liable for computer piracy acts nor be blamed for any damages or loss to a C&S member or user. C&S website can sustain occasional failures and some programming errors could be caused by updates or events independent of the will of the administrators.

The price payable for each product that you order is the appearing next to each product offered on the Site. Transportation and delivery costs are not included and the responsibility of the customer and will be calculated on the basis of the country where the products will be delivered to the current pricing of Postes Canada. These rates take into account the weight and the volume of the parcel to be delivered. You can request a quotation at any time to know your potential order total. After receiving the quote, you can confirm your order or not to follow. Sales taxes are added depending on the country where the products will be delivered. A handling fee may be added at the discretion of C&S, in the case of a particular delivery requiring special conditions. If this is the case, you will be informed at the time of the preliminary estimate.

Availability of products
In the event where C&S must wait one or more out of stock items to become available(s), may your command to be successful then shipped. You will be notified by email of this situation. If ever you’re in a hurry to receive one or some items in your order, please add a mention in the note available in the form when you purchase your goods, or by mail or phone. C&S will be at no time responsible for any damages that you could suffer due to out of stock.

Delivery of products
C&S will deliver the products ordered by you to the address you transmitted when ordering. Please note that no delivery will be made to a post office box. C&S must have received full payment for products which must be delivered prior to their delivery. The delivery will be effected by post Canada on behalf of C&S as soon as possible after acceptance of your order. The time and cost of delivery may vary according to the destination of the shipment and the availability of the products. Generally, these delays should not exceed ten working days. You become owner of the products that you have ordered when they are given by C&S to the transport company. From this moment, you will be required to assume the risks and C&S will not be liable for their loss or destruction. For any product delivered outside of the Canada, you are responsible for all customs clearance costs and any other expenses inherent to export outside the Canada.

Delivery of products is subject to the rules of the shipping companies with whom C&S do business, in this case Postes Canada, as well as to the rules of any other company with which C&S may do business from time to time. We do generally deal with service XPress Postes Canada and the delivery time – after leaving our offices – is 4-10 business days in Canada and USA. This delay may go as far as 30 days if you choose the surface shipment (boat or crates) in countries outside Canada. However, although we were always trying to deliver your parcel in the best possible conditions, we can give no guarantees regarding this period or any other conditions relating to the expedition.

Product returns
You can return products to C&S at any time until the end of the 30th day after receipt to the same address previously stipulated. Products must be accompanied by the invoice or packing slip and be returned in the original packaging. No justification to C&S in such a case, nor penalty to pay.

To return products for reasons other than a failure on our part: you will need to assume shipping costs and risks for the returned product. You cannot return products when you have removed the products from their original packaging or, in the case of books, when they are damaged or the cover is folded, except if the products are defective. To return defective products: If an item is defective, it will be exchanged for a new copy of the same product. If C&S has not delivered you the products you have ordered, C&S will resend the good products and will assume transportation costs and risks, as far as you have contacted our service customer within 7 working days of receipt of the package and that it is agreed that the carrier to send it to us. (The defective term also applies to the components of the products, missing or incorrect). Upon receipt of the returned products, any sum debited from your card account credit in favor of C&S for such products, except delivery charges, will be credited as soon as possible, provided however that the products subject to the return have been returned by you and received by C&S in the same condition as that in which they were when they have been delivered to you.

In the event where the liability of C&S to you could be retained, it shall be limited to an amount of money equal to the price paid by you for the returned product. C&S shall not be liable for non-performance, in whole or in part, of one any of its obligations towards you, nor for any damage or loss you may suffer, breach, damages, or losses resulting from a case of force majeure or circumstances beyond its control.

Good faith
You will understand that these conditions here are not restrictive and are useful in extreme cases where one of the parties would show evidence of bad faith. Rest assured that we are always trying to give full satisfaction to our customers and we have at heart to settle any dispute in a just and honest way for both parties.
